As part of settling divorce proceedings or a separation agreement, it is very important for the parties to settle their financial and property affairs (contact and custody of children is dealt with separately) so that the family assets are fairly distributed following the dissolution of the marriage.
A record of the settlement can be set out in an agreement known as a consent order. This can save time and money in the long run and is helpful where the terms and division of assets are clear and reached amicably.
However if an agreement cannot be reached it may be necessary to begin proceedings for ancillary relief orders which means orders to deal with income, property and other capital assets including pensions.
